Options are very important…especially in a divorce.

Most people are shocked to know there are many options for different scenarios and pros and cons should be weighed for each.

  1. Mediation: Mediation has special protection under the law such that communications in mediation generally cannot be presented to the Court. This could be good or bad, depending on your case and issues.
    Mediation is a cost-effective way to resolve a dispute but it’s important to remember the mediator does not represent either side. It is the mediator’s job to get both parties to the middle.
  2. Negotiated Settlement: A negotiated settlement can be negotiated amongst lawyers, legal teams with accountants and lawyers practicing in other areas, therapists, and more. It is also an option to hire a private judge to facilitate mediation to work on a negotiated settlement.
  3. Trial: If mediation or negotiation fails or stalls, it might be necessary to engage in litigation to move the matter forward. To do so, the court will set a trial date where evidence is presented to support each side’s position. Trial is a lengthy and costly process so it is best to have a team that will openly communicate with you the goals, path, and costs along the way.
